On December 16, 2012, Nirbhaya (aka Jyoti Singh Pandey) a 23-year-old physiotherapy student was brutally gang-raped and assaulted by 6 people. The victim later died of her injuries in a Singapore hospital.

Earlier, the Nirbhaya (Jyoti Singh Pandey's) family demands nothing less than capital punishment, the convicts -- Mukesh (26), Akshay Thakur (28), Vinay Sharma (20) and Pawan Gupta (19) -- have begged for mercy before Additional Sessions Judge Yogesh Khanna, who had held them guilty of gangrape and “cold blooded” murder of a “defenceless” 23-year-old girl in a premeditated manner. Being found guilty for the murder, the statute provides a minimum of life sentence and maximum of death penalty for such henious crime. The judge says that this was an inhuman act, and comes under rare of the rarest category.
Fruit-seller Mukesh Singh and Pawan Gupta, bus cleaner Akshay Thakur and Gym instructor Vinay Sharma, who were found guilty in all 13 charges, including murder and rape, were given death sentence by judge. Out of the six men arrested in the case, Ram Singh committed suicide inside Tihar Jail. Another accused, who was 17 at the time of the crime, was sent to reform home for three years by a juvenile court.
This case have changed the way of thinking of our society. Now the public have made their mind that the way of getting justice is not easy, and they need to fight for their rights.
The Indian Penal Code (IPC) was amended to provide death penalty in rape cases that cause death of the victim or leave her in a vegetative state. The Criminal Law Amendment Act 2013 also introduced several other new offences such as causing grievous injury through acid attacks, sexual harassment, use of criminal force on a woman with intent to disrobe, voyeurism and stalking.
The court while pronouncing the judgment said that "it cannot turn a blind eye on the rising cases of sexual assualt against women" and that the incident shook the "collective conscience of the society". The court said the case falls under rarest of rare category. "In these times when crime against women are on rise, we cannot turn a blind eye towards such gruesome crime,we need to send a message that it will not be tolerated," the judge said.Noted lawyer Advocate Lekhraj Sharma, Additional Advocate General Punjab, said the decision is fully justified. "If ever there was a rarest of rare case, this is the one. I had full confidence, that the court will give maximum sentence as it is fully justified and appropriate."

Hopefully, this death sentence would create fear in the minds of people for good, and such unfortunate incidents would stop occuring. Though Delhi city have seen a highest number of rape cases in 2013, but we shouldn't lose hope. Let other know, what you think about this death sentence, and whether this is sufficient or there should be something more like electric shocks, hitting with stones, making impotent etc, which is a known practice with rapists in gulf countries.
I strongly support this decision of court, there was no other better punishment than this

ReplyDeleteAs shown on TV show Savdhan India... Before Damini got into the bus the auto richshaw driver refused to take her to her house. Before Damini got into the bus, the 4 accused had robbed a passenger 'X' and threw him out of the bus after robbing all his money and cell phone. Shortly thereafter Mr X met 2 police officers on the road and complained about the bus and being robbed by the 4 occupants of the bus. these two police officers did nothing saying its not in their jurisdiction. so i hope the Judge has also thought of giving some punishment to these persons like the rickshaw driver, the police officers who did not do their duty. fine imposed by RTO on auto driver for not taking passengers is Rs.100/-.

Damini had so much to live for. but becoz our system does not take strict action against those who do wrong, lives are lost and so is hope of the common man. However, if the relevant Judge passes some good judgement on the balance people responsible for Damini's death, a Damini story will be prevented from happening again. Punishment is the best deterrent.
