Nobody leaves their home in the morning expecting that they are going to get hurt at work; however, this can still happen from time to time. Employers have very specific responsibilities when it comes to the safety and welfare of their employees.

When an employee gets hurt on the job, that individual might be able to sue their employer for injury. When it comes to suing an employer for the injury, an employee has to meet a few criteria for that lawsuit to be successful.

An Injury Took Place

While this might sound like an obvious step, the employee still has to prove that an injury took place. What this means is that the employee has the responsibility to show that meaningful damage was sustained in some way. While this might be as simple as producing medical records, this is still something that has to take place in order for any lawsuit to move forward.

Acting Within the Scope

Next, the employee has to show that these damages were sustained while acting within the scope of his or her employment. For example, if an employee takes a commercial vehicle joyriding in the middle of the night and crashes it, the injuries sustained in this accident would not be covered under any personal injury lawsuit against the employer even though the injuries were sustained while using a work vehicle. The employee has to be acting within the scope of his or her employment when the injury was sustained. Usually, the scope is specified in the employment contract, which is usually signed by the employee prior to the first day.

The Employer had a Reasonable Duty

Sometimes, employees sustain injuries while at work that are unavoidable. In other cases, these injuries might be sustained as a result of some form of neglect on behalf of the employer. The lawsuit has to be able to prove that the employer had a reasonable duty to do more than he or she did. For example, an employee might suffer a serious injury as a result of inadequate training on behalf of the employer. The employer has a duty to make sure that all employees are trained in whatever skills they are going to be using while at work.
